Interviewing applicants: Legal issues, FAQs ? Business ...

Interview questions must not only produce useful information for making informed hiring decisions, but also stay on the right side of employment laws. Anti-discrimination acts make it imperative that interviews focus on applicants' abilities, not their personal characteristics, whether they involve disability, pregnancy, age, sex or religion.

1. What is considered an illegal disability-related interview question?

The Equal Employment Opportunity Commission defines an illegal disability-related question as one that is likely to elicit information about a disability. At the pre-offer stage, an employer cannot ask questions that are likely to elicit information about a disability. It also means that an employer cannot ask questions that are closely related to disability.
